Icon Luxury Motorhome Hire
‘Icon Experiences’ means Icon F1 Limited, International Logistics Centre, Fosse Way, Newark, NOTTS, NG244SP.
‘Customer’ means the person or persons nominated as the hirer and whose credit card is presented in payment of the Customer’s charges.
‘Motor Home’ is the vehicle with registration no SNZ 8103 , otherwise known as the Icon RV or Icon Luxury Motorhome, and includes all parts and accessories fitted to it at the commencement of the Rental Period.
‘Living Equipment’ includes but is not limited to the Xbox, LCD TV screen, DVD player, sound system, washing machine, microwave, crockery, cutlery, cooking utensils, bed linen and towels.
‘Rental Agreement’ is the contract for hire of the Motor Home, which incorporates these Terms and Conditions, as entered into between the Customer and Icon Experiences.
‘Rental Period’ means the hire period as stated on the Rental Agreement and any additional period during which the Motor Home is in the Customer’s possession or control.
2: Deposit and Terms of Payment
The ‘Rental Charge’ is the amount quoted by Icon Experiences as stated in the Rental Agreement.
The ‘Rental Deposit’ is 50% of the Rental Charge.
A booking will only be confirmed upon payment of the Rental Deposit. Icon Experiences reserves the right to cancel a booking where the Rental Deposit has not been paid. On making the booking an acceptance form will need to be signed and returned.
The remaining 50% of the Rental Charge is payable four weeks prior to the commencement of the Rental Period or immediately where a booking is made less than four weeks in advance.
An additional ‘Security Deposit’ will be required and confirmed upon booking depending on the rental. It is payable four weeks prior to the commencement of the Rental Period or immediately where a booking is made less than four weeks in advance.
Icon Experiences will refund the Security Deposit, less any sum deducted for loss, damage or expenses to the Motor Home or Living Equipment pursuant to Condition 5.1, within 7 working days of the end of the Rental Period. Should the deductible sum exceed the amount of the Security Deposit, the Customer will be required to pay all additional monies within 7 working days of the end of the rental period. If the value of the damage exceeds the value of the deposit you are liable for immediate payments of the full value of the damage. However you can take out a damage waiver policy in order to protect yourself against damages.
Failure by the Customer to pay all monies and charges due will result in late charges of 1.5% per month on the outstanding balance. The Customer will also be liable to pay any collection costs reasonably incurred by Icon Experiences, including legal fees. A fully comprehensive insurance policy is available on request to cover all damages made during the rental period.
Where the Customer comprises of more than one person, each person is jointly and separately liable for all the obligations of the Customer pursuant to the Rental Agreement.
Any cancellation by the Customer must be made in writing.
If notification of cancellation is received more than four weeks prior to the commencement of the Rental Period, the Customer will be refunded in full.
If notification of cancellation is received less than four weeks prior to the commencement of the Rental Period, the Rental Deposit (50% of the Rental Charge) will be non-refundable.
If notification of cancellation is received less than two weeks prior to the commencement of the Rental Period, the entire Rental Charge will be non-refundable.
4: Hand-Over and Return
Please allow 1 hour for the hand-over of the Motor Home so as to complete all necessary documentation and allow for a demonstration of the equipment on board.
Possession of the Motor Home must be given up to Icon Experiences on the date and before the time stated in the Rental Agreement.
Icon Experiences must be notified immediately in the event that the Motor Home will be returned late. After an initial grace period of 1 hour, an additional charge of £100 per hour is payable for all late returns.
The Motor Home must be returned to Icon Experiences clean and in the same condition as at the commencement of the Rental Period pursuant to Condition 5.1.
Icon Experiences will not be responsible for any of the Customer’s belongings left behind in the Motor Home at the end of the Rental Period.
5: Condition and Use
5.1 Condition of the Motor Home
A description of the condition of the Motor Home will be given to the Customer prior to the commencement of the Rental Period.
The Customer is required to check the condition of the Motor Home. Where an apparent defect is found, amendments must be made to the document and it duly signed by both parties.
The Customer must return the Motor Home clean and in the same condition as at the commencement of the Rental Period.
The Customer will be liable for the cost of all loss or damage caused by neglect, accident or misuse, including but not limited to the following situations;
The Motor Home or Living Equipment requires more than standard valeting (cleaning)
The Motor Home or Living Equipment has suffered any loss or damage inside or out, how so ever caused.
Such costs of replacement, repair or refurbishment will be deducted from the Security Deposit pursuant to Condition 2.
The Customer will not be liable to pay for any damage to the Motor Home or Living Equipment caused by reasonable wear and tear, or any routine maintenance work required.
5.2 Use of the Motor Home
The Customer must use the Motor Home in a responsible manner and in particular only for the purpose which it is intended, as a non-movable place of accommodation.
In particular, the Customer must not;
Attempt to drive or move the Motor Home under any circumstances
Use the Motor Home for racing, pacemaking, testing the vehicles speed, transporting goods, pushing or towing another vehicle or giving driving lessons
Sell, assign, sublet, lend, pledge or otherwise part with or dispose of the Motor Home, Living Equipment or any part thereof or any of the
Use the Motor Home for hire or reward
Smoke whilst in the Motor Home. If any person smokes in the Motor Home, a sum of £500 will be deducted from the Security Deposit for deep cleaning.
Allow pets into the Motor Home without prior consent of Icon Experiences. If any pets are suffered to be inside the Motor Home, a sum of £500 will be deducted from the Security Deposit for deep cleaning.
Use the Motor Home while under the influence of alcohol, drugs or other narcotic substances
Use the Motor Home for any illegal purpose
Intentionally commit any offence.
The Customer warrants to;
Lock the Motor Home whenever it is unoccupied or not in use.
6: Maintenance and Mechanical Problems
Icon Experiences will carry out a full inspection of the Motor Home and ensure the systems on board are operating correctly prior to the commencement of the Rental Period.
Should any on board system fail during the Rental Period, Icon Experiences will make reasonable endeavours to remedy the fault. In the event that this is not possible, Icon Experiences will not be liable or refund any monies to the Customer in lieu of loss of service.
The Customer must inform Icon Experiences as soon as they become aware of any mechanical problem or fault with the Motor Home or any item of the Living Equipment, and in the event of any loss or damage.
The Customer must not suffer anyone to work on the Motor Home without the prior consent of Icon Experiences. Where permission is granted, the Customer will only receive reimbursement for any routine maintenance work carried out upon presentation of a receipt.
The Motorhome ( R V ) is Fully Insured for the Highway. Icon F1 Ltd are however not liable /Insured for Injury-damage or loss to any occupants or belongings whilst being rented or used. Please ensure you have holiday Insurance in place or contact Icon F1 Ltd to give you a quotation for Accidental and Personal Insurance Cover.
8: Release and Indemnity
The Customer agrees to release Icon Experiences, its employees and agents, regardless of who is at fault, from any liability, damage, loss or expense incurred by the Customer by reason of the Rental Agreement, including but not limited to;
Any loss or damage caused by accident, breakdown or mechanical failure of the Motor Home
Any loss or damage to any property left in the Motor Home, or in any Icon Experiences vehicle or premises
Any indirect consequential loss, loss of profit or earnings.
The Customer agrees to indemnify Icon Experiences, its employees and agents against any claims, demands and expenses (including legal costs) incurred or sustained by reason of the Customer’s use or possession of the Motor Home.
9: Terminating the Agreement
Icon Experiences reserves the right to terminate this Agreement and repossess the Motor Home at any time, without notification to the Customer, including but not limited to the following circumstances;
The Customer is in breach of any term of this Agreement
The Customer has obtained use of the Motor Home through any fraud or misrepresentation
The Motor Home appears to be abandoned
Possession of the Motor Home is not returned on the agreed date and time and in the absence of notification of extension of the Rental Period
Icon Experiences considers on reasonable grounds that the safety of the passengers or the condition of the Motor Home is in danger.
In the event of such termination or repossession, the Customer will be liable for any reasonable costs incurred by Icon Experiences.
In the event of such termination or repossession, the Customer has no right to a refund of any part of the Rental Charge or Security Deposit.
10: Force Majeure
Icon Experiences will make every effort to ensure the Motor Home is available and fit for use at the commencement of the Rental Period. If this is not possible due to circumstances beyond the control of Icon Experiences, liability of Icon Experiences is limited to refunding all monies paid by the customer. Icon Experiences will not be liable to pay any compensation, costs or expenses of the Customer.
Any changes to the Rental Agreement must be made in writing and signed on behalf of Icon Experiences and the Customer.
12: Governing Law
The Rental Agreement is governed by the laws of Great Britain in which the Rental Agreement was signed.
13: Data Protection Act
The information provided by the Customer to Icon Experiences will be used solely for the purpose of fulfilling the Rental Agreement. Except where the Customer is in breach of the Rental Agreement, Icon Experiences will not pass this information on to any other organisation. Where the Customer is in breach of the Rental Agreement, information may be provided to credit reference agencies, debt collectors, the British Vehicle Licencing Authority (DVLA) and any other relevant organisation.
14: Entire Agreement
The Rental Agreement incorporating these Terms and Conditions constitutes the entire agreement between the Customer and Icon Experiences. There are no other oral undertakings, warranties or agreements between the parties relating to the subject matter of the Rental Agreement.
